The relationship between corporate executives and shareholders has riveted the attention of business ethicists since the inception of the field. Most ethicists agree that corporate executives owe their investors the duties of loyalty, candor, and care. These fiduciary duties undergird the promises made to shareholders at the time of incorporation, placing on executives moral obligations to engage in fair dealing and to avoid conflicts of interest.We concur that executives owe all of their existing shareholders both promise-keeping and fiduciary duties and (...) argue that some corporateexecutives violate these responsibilities by attempting to withhold information from or limit information to some shareholders while courting others. We analyze the ethical implications of six techniques and tools that executives use to attract certain types of shareholders while deterring others. This paper explores the effect of structurally enacted governance, such as board membership rules, versus process enacted governance, such as disclosure practices, on investor trust. Certain organizational factors are proposed due to their ability to inform trust propensity and transparency enactment. Regulatory oversight, organizational structure and investor salience are considered in light of their effect on relational and transactional approaches to a company’s investors.

This paper provides a framework for beginning the discussion of how and why corporate disclosure programs vary in their scope. It posits that managerial agency along with certain external forces, such as disclosure regulations, will affect the scope and managerial commitment to a broad or narrow disclosure program scope. Preliminary findings are presented in brief form.

The common thread running through the logicism of Frege, Dedekind, and Russell is their opposition to the Kantian thesis that our knowledge of arithmetic rests on spatio-temporal intuition. Our critical exposition of the view proceeds by tracing its answers to three fundamental questions: What is the basis for our knowledge of the infinity of the numbers? How is arithmetic applicable to reality? Why is reasoning by induction justified?

These are the Aquinas Lectures for 1993 given at Marquette University by Jesuit priest W. Norris Clarke. There is an Introduction, two main sections, and ten chapters, including "The Meaning of Person" and "The Problem of Evil".

In this article, we discuss a simple argument that modal metaphysics is misconceived, and responses to it. Unlike Quine's, this argument begins with the simple observation that there are different candidate interpretations of the predicate ‘could have been the case’. This is analogous to the observation that there are different candidate interpretations of the predicate ‘is a member of’. The argument then infers that the search for metaphysical necessities is misguided in much the way the ‘set-theoretic pluralist’ claims that the (...) search for the true axioms of set theory is. We show that the obvious responses to this argument fail. However, a new response has emerged that purports to prove, from higher-order logical principles, that metaphysical possibility is the broadest kind of possibility applying to propositions, and is to that extent special. We distill two lines of reasoning from the literature, and argue that their import depends on premises that any ‘modal pluralist’ should deny. Both presuppose that there is a unique typed hierarchy, which is what the modal pluralist, in the context of higher-order logic, should disavow. In other words, both presupposes that there is a unique candidate for what higher-order claims could mean. We consider the worry that, in a higher-order setting, modal pluralism faces an insuperable problem of articulation, collapses into modal monism, is vulnerable to the Russell-Myhill paradox, or even contravenes the truism that there is a unique actual world, and argue that these worries are misplaced. We also sketch the bearing of the resulting ‘Higher-Order Pluralism’ on the theory of content. One theme of the discussion is that, if Higher-Order Pluralism is correct, then there is no fixed metatheory from which to characterize higher-order reality. (shrink)

If this simpleminded man, who as known was out of his mind, so sneered at our textbooks, then one might answer him, consoled: Good, but there are also a lot of things in our textbooks that are neither in heaven nor on earth.

The ArgumentThe Doctor of Philosophy, a nonmedieval academic figure who spread throughout the globe in the Modern Era, and who emblemized the transformation of academic knowledge into the “pursuit of research,” emerged through a long and tortuous path in the early modern Germanies. The emergence and recognition of the Doctor of Philosophy would be correlative with the nineteenth-century professionalization of the arts and sciences. Throughout the Early Modern Era, the earlier Doctors and older “professional” faculties from the medieval university — (...) Theology, Law, and Medicine — opposed recognition of the Doctor of Philosophy. In Saxony, the forces of “medievalism” were able to block recognition of the Doctor of Philosophy, and they retained the degraded Master of Arts or Philosophy as the highest degree in arts and sciences. Forces of “modernism” prevailed, however, in Austria and Prussia in the late eighteenth and early nineteenth centuries. In Austria, the Doctor of Philosophy arrived as a wholly modern figure, the creation of a nice dossier and a civil service examination: the medieval “juridical” persona became a modern “bureaucratic” persona. Between this bureaucratic modernism of the Austrians and corporatist medievalism of the Saxons, the Prussians pursued a via media. Unlike the Saxons, they recognized the Doctor of Philosophy; but unlike the Austrians, they did not completely bureaucratize the candidate's persona. The Prussians demanded from the candidate a “work of research,” a doctoral dissertation, which exhibited the aesthetic qualities of the Romantic artist: originality and personality. (shrink)

In this paper we provide a psychological account of the nature and development of explanation. We propose that an explanation is an account that provides a conceptual framework for a phenomenon that leads to a feeling of understanding in the reader/hearer. The explanatory conceptual framework goes beyond the original phenomenon, integrates diverse aspects of the world, and shows how the original phenomenon follows from the framework. We propose that explanations in everyday life are judged on the criteria of empirical accuracy, (...) scope, consistency, simplicity, and plausibility. We conclude that explanations in science are evaluated by the same criteria, plus those of precision, formalisms, and fruitfulness. We discuss several types of explanation that are used in everyday life – causal/mechanical, functional, and intentional. We present evidence to show that young children produce explanations that have the same essential form as those used by adults. We also provide evidence that children use the same evaluation criteria as adults, but may not apply those additional criteria for the evaluation of explanations that are used by scientists. This book is a revised and expanded edition of three lectures delivered by the author as the centerpiece of a symposium on the philosophy of God at Wake Forest University in 1979. Long out of print, in its new edition it should be a valuable resource for scholars and teachers of the philosophy of religion. The first two lectures, after a critique of the incompleteness of St. Thomas Aquinas's famous Five Ways of arguing for the existence of God, explores two (...) lesser-known resources of Aquinas's philosophical ascent of the mind to God. The first is the unrestricted dynamism of the human spirit, both intellect and will, reaching toward the fullness of being as both true (i.e., intelligible) and good. The second is the strictly metaphysical ascent to God from finite to infinite, in the line of Aquinas's later, more Neoplatonically inspired, metaphysics of participation. The third lecture is a critique of Whitehead's process philosophy. It asks: Is process philosophy compatible with Christian theism? This article is heavily revised from its earlier version, distinguishing Aquinas more sharply and critically from Whitehead than in the first edition. (shrink)

This volume brings historians of science and social historians together to consider the role of "little tools"--such as tables, reports, questionnaires, dossiers, index cards--in establishing academic and bureaucratic claims to authority and objectivity. From at least the eighteenth century onward, our science and society have been planned, surveyed, examined, and judged according to particular techniques of collecting and storing knowledge. Recently, the seemingly self-evident nature of these mundane epistemic and administrative tools, as well as the prose in which they are (...) cast, has demanded historical examination. The essays gathered here, arranged in chronological order by subject from the late seventeenth to the late twentieth century, involve close readings of primary texts and analyses of academic and bureaucratic practices as parts of material culture. The first few essays, on the early modern period, largely point to the existence of a "juridico-theological" framework for establishing authority. Later essays demonstrate the eclipse of the role of authority per se in the modern period and the emergence of the notion of "objectivity." Most of the essays here concern the German cultural space as among the best exemplars of the academic and bureaucratic practices described above. The introduction to the volume, however, is framed at a general level the closing essays also extend the analyses beyond Germany to broader considerations on authority and objectivity in historical practice. Genetic diseases can be every bit as devastating as the diseases caused by bacteria or viruses, and in one way they are much worse: we pass them on to our children, generation after generation after generation. Science and medicine have provided us with clues to the treatment of a few genetic diseases, although by their very nature they have never been considered curable. But, as William R. This paper presents a cognitive account of the process of evaluating scientific data. Our account assumes that when individuals evaluate data, they construct a mental model of a data-interpretation package, in which the data and theoretical interpretations of the data are integrated. We propose that individuals attempt to discount data by seeking alternative explanations for events within the mental model; data-interpretation packages are accepted when the individual cannot find alternative accounts for these events. Our analysis indicates that there are many (...) levels at which data-interpretation packages can be accepted or denied. (shrink)

ArgumentMuch recent research has established the importance of visualization in modern science. This essay treats, instead, of the continued importance of the aural and oral: the professorial voice. The professor remains important for science since so many scientists still instantiate this persona and, as is here argued, a “voice” constitutes an essential feature of it. The form of the essay reflects its contents. From the Middle Ages until well into the modern era, the archetypal professorial genre was the disputation, an (...) oral event recast in written form. Apropos of the traditional disputation, this essay begins with a disquisition more or less to the point. It concerns Nietzsche’s first major publication, which violated norms for the proper professorial voice, thus accelerated the destruction of his academic career. The essay then presents six theses on the professorial voice. The theses treat relevant aspects of the professorial voice from the Sophists onward. It is argued, in Weberian terms, that the professorial voice or persona embodies elements of charismatic and traditional authority which coexist with and condition the rational authority or “objectivity” of science. This paper presents an analysis of the forms of response that scientists make when confronted with anomalous data. We postulate that there are seven ways in which an individual who currently holds a theory can respond to anomalous data: (1) ignore the data; (2) reject the data; (3) exclude the data from the domain of the current theory; (4) hold the data in abeyance; (5) reinterpret the data; (6) make peripheral changes to the current theory; or (7) change the theory. (...) We analyze psychological experiments and cases from the history of science to support this proposal. Implications for the philosophy of science are discussed. (shrink)

The ArgumentUsing a pernicious Foucaultian reading of Weber's rationalization theories, I endeavor in this essay to illuminate academic acts as kept in the Brandenburg-Prussian state archive in Berlin, with some comparison to others, chiefly those in the Bavarian state archive in Munich. The essay concerns the microtechniques of marking, collecting and keeping records, and the form and content of archives of academic acts – interesting for the reason that paperwork circumscribes the state ministry's ability to recollect academic acts and hence (...) its power and knowledge over academics. I consider mostly acts relating to the early modern “Arts and Philosophy Faculty,” which corresponds more or less to the present-day “Division of Arts, Letters and Sciences.” The transformation, traced from the Baroque to the Romantic era, is understood as a process of “ministerial-market rationalization” of German academia: I try to show how central German ministries, as reflected in archival acts, altered the academic persona to suit themselves and the market, and how professorial appointments were rationalized accordingly.
